National Credit Union Administration Board v. UBS Securities, LLC, et al., No. 12-cv-2591 (D. Kan. 2012) (lead counsel for FDIC as amicus curiae) (consolidated with four other cases filed under the Securities Act of 1933 by NCUA on behalf of credit unions that purchased residential mortgaged-backed securities (RMBS) against the RMBS issuers and underwriters, holding NCUA's suit was time barred because suit was filed outside the statute of limitations, despite UBS Securities having agreed previously that the statute of limitations was tolled). But see NCUA v. Barclays Capital, Inc., 785 F.3d 387 (10th Cir. 2015) (lead counsel for FDIC as amicus curiae) (overruling NCAU v. UBS Securities, LLC and related cases).
